On 22 July 2022, the International Court of Justice (ICJ) is expected to release its judgement on the preliminary objections in the Gambia v. Myanmar case. On this occasion, AJAR is making public its online course on the international accountability mechanisms for Myanmar.
In Friday’s judgement, the ICJ will decide whether it will continue with the case against Myanmar. The ICJ case, which is about the responsibility of the Myanmar State under the Genocide Convention, should not be confused with the proceedings at the International Criminal Court (ICC).
At the ICC, the Prosecutor is conducting an investigation into crimes against humanity allegedly committed against the Rohingya which took place at least in part on Bangladesh territory. In contrast with the ICJ, the ICC deals with personal criminal responsibility of individual perpetrators.
In addition, the Independent Investigative Mechanism for Myanmar (IIMM) is also working to collect evidence of crimes committed in Myanmar since 2011 and to prepare files for prosecution, while a Federal Court in Argentina started investigative proceedings regarding crimes against the Rohingya, under the principle of universal jurisdiction.
AJAR’s online course aims at increasing the knowledge and understanding of civil society groups in Myanmar and around the world with respect to these mechanisms. It covers issues regarding their respective mandates, the scope of their work, expectations about their next steps, their limitations and advantages, and how civil society can engage with them.
The online course is available in English and Burmese language. Each of the eight modules contains a training video, a written handout and quiz questions, to facilitate self-learning by participants:

သောကြာနေ့တွင်ချမှတ်မည့် စီရင်ချက်တွင် ICJ အနေဖြင့် မြန်မာနိုင်ငံအပေါ် အမှု ဆက်လက်ဆောင်ရွက် ရန် ရှိ၊ မရှိကို ဆုံးဖြတ်မည်ဖြစ်သည်။ မြန်မာနိုင်ငံအနေဖြင့် လူမျိုးတုံးသတ်ဖြတ်မှုဆိုင်ရာ သဘော တူညီစာချုပ်အောက်ရှိ တာဝန်နှင့်သက်ဆိုင်သော ICJ ၏ အမှု အား နိုင်ငံတကာ ရာဇဝတ်တရားရုံး (ICC) ၏ တရားစွဲ ဆိုမှုများနှင့် မရှုပ်ထွေးသင့်ပေ။
ဘင်္ဂလားဒေ့ရှ်၏ ပိုက်နက်အချို့ အနည်းဆုံး တစ်စိတ်တစ်ပိုင်း တွင် ရိုဟင်ဂျာများအပေါ် လူသားမျိုးနွယ် အပေါ် ကျူးလွန်သည့် ရာဇဝတ်မှုများကို ICC မှ အစိုးရ ရှေ့နေများမှ စုံစမ်းစစ်ဆေးမှုများ ပြုလုပ်နေ ပါသည်။ ICJ နှင့် ကွဲပြားသည့်အချက်မှာ ICC သည် ကျူးလွန်သူတစ်ဦးချင်းစီ၏ ရာဇဝတ်မှု ဆိုင်ရာ တာဝန်များ ကို ကိုင်တွယ်ပါသည်။
ထို့အပြင် အာဂျင်တီးနားမှ အပြည်ပြည်ဆိုင်ရာ တရားစီရင်ခွင့် အရ ရိုဟင်ဂျာများ အပေါ်ကျူးလွန်ခဲ့ သည့် ရာဇဝတ်မှုများအတွက် စုံစမ်းစစ်ဆေးမှု စတင်၍ လုပ်ဆောင်သည် နှင့် မြန်မာနိုင်ငံဆိုင်ရာ လွပ်လပ်သော နိုင်ငံတကာစုံစမ်းစစ်ဆေးရေး ယန္တရား သည် 2011 ခုနှစ်မှ စတင်၍ ကျူးလွန်ခဲ့သော ရာဇ ဝတ်မှု ဆိုင်ရာ သက်သေအထောက်အထားများကို စုဆောင်းရန်လုပ်ဆောင်နေပြီး တရားစွဲဆိုရန် အတွက် အမှုတွဲများ ကို ပြင်ဆင်လျက်ရှိပါသည်။
